#137 Gladstone Drink Driving

All right. I'm at Gladstone Magistrates Court. Client was charged with low range drink driving reading of 0.085. He was eligible to apply for a DUI drink driving work licence, but given he wasn't going to lose his job, his employer obviously wasn't willing to sign an affidavit to say that he was, so there was no need to apply for a DUI drink driving work licence.
As far as preparing goes, I got him to complete an online course, which could be done online if you live regionally. Got him to get some references based on a template we provide all of our clients. I got instructions from him prior to today, flew up this morning, met him at court, grabbed the conference room, ran through what I was going to say and the procedure, et cetera.
I guided the magistrate through the difficulties that he'll suffer while he is off the road, notwithstanding the fact that he won't lose his job. I went into submissions about why, in my mind, I thought it would be appropriate for a conviction not be recorded.
The short version is I was able persuade the magistrate to give the man a minimum one month and no conviction recorded. So one month disqualification, no conviction recorded. Client's very happy, modest fine.
