
When a driver is directed to stop by Police and they fail to pull over as soon as reasonably practicable, they will be charged with an Evasion Offence. For those facing their first Evasion Offence, they face a minimum penalty of either 50 penalty units (at the time of writing a penalty unit is valued at $154.80, making the fine $7740), or 50 days imprisonment which must be served wholly in a corrective services facility. This means that any term of imprisonment cannot be wholly suspended or served by way of immediate parole, and if given the imprisonment rather than the fine, they must spend 50 days in jail. The maximum penalty for this offence is 200 penalty units and 3 years imprisonment. This escalates to 300 penalty units and 5 years imprisonment if the offence was committed either at night or in company, or where there were threats of violence or actual violence, threats or actual damage to property, or use of a weapon. A 2 year nationwide licence disqualification also applies to an Evasion Offence.
