Perfume Fooling Drink Driving RBTs: 4BC With DUI Lawyer Andrew Wiseman
I appeared on 4BC today to discuss reports within the media, particularly Ben McClellan’s article in the Courier Mail, of new DUI Drink Driving breathalyser technology being triggered by innocent items such as perfume, hand sanitiser, toothpaste and chewing gum.
As you will hear in the video below, I assured 4BC’s Afternoons presenter Clare Blake that an overzealous application of Chanel No. 5 will not give cause for you to be brought before a Magistrate.
As I explain in the interview, roadside breath tests are indicative only, meaning the new devices are only calibrated to indicate a positive or negative result.
It is only once a positive result is indicated that a formal, more succinctly calibrated device is used, in either the Booze Bus or at the Police Station.
So, rest assured, bathing in Jean Paul Gaultier Ma Dame will not put you before the Magistrate.
Queenslanders charged with first time DUI Drink Driving face a maximum penalty of a lifetime driver’s licence disqualification, 9 months imprisonment and 28 penalty units.
Magistrates have a general power to impose up to a lifetime driver’s licence disqualification, above and beyond any legislated disqualification ranges.
A penalty unit in Queensland is currently valued at $113.85.
Further, persons who plead or are found guilty in the Magistrates Court must pay the Offender Levy, which is presently worth $107.10.
