BEENLEIGH: Making Unnecessary Noise Or Smoke (Burnout) With Previous
I appeared at Beenleigh Magistrates Court again this morning to represent a client charged with Making Unnecessary Noise or Smoke, otherwise known as doing a Burnout.
My client had extensive traffic history including Street Racing and 2 DUI Drink Driving offences.
My client had also previously been charged with Making Unnecessary Noise or Smoke, for which they received a 9 month disqualification.
That said, all of the previous offending was over 5 years ago.
Work or Hardship Licence eligibility does not attach to this type of offence.
As a Steelworker, my client needed to drive to locations not properly serviced by public transport or at all.
Given my client was not eligible to apply for any kind of Work or Hardship Licence, my role was one of either getting my client a fine only, or getting any disqualification down as low as possible.
My client faced a maximum penalty of a lifetime driver’s licence disqualification and 20 penalty units.
Magistrates have a general power to impose up to a lifetime driver’s licence disqualification, above and beyond any legislated disqualification ranges.
A penalty unit in Queensland is currently valued at $113.85.
Further, persons who plead or are found guilty in the Magistrates Court must pay the Offender Levy, which is presently worth $107.10.
I made detailed and comprehensive verbal submissions to the Magistrate covering a number of key aspects.
I was able to persuade the Magistrate not to disqualify my client's licence.
My client received a $450 fine only.
My client was extremely happy.
