MAROOCHYDORE: High Range DUI Drink Driving 0.154 Repeat Offender

I drove up to Maroochydore Magistrates Court this morning to represent a client charged with High Range DUI Drink Driving with a blood alcohol concentration of 0.154.

The client was a repeat DUI Drink Driver, having previously been charged with a blood alcohol concentration of 0.203.

However, that previous did occur outside of the last 5 years. For his High Range DUI Drink Driving offence the client faced a maximum penalty of a lifetime loss of licence, 9 months imprisonment and 28 penalty units.

At the time of writing this, a penalty unit in Queensland is worth $113.85. Given the previous offence was more than 5 years ago, the mandatory minimum disqualification was 6 months.

Had the previous been within the last 5 years, the minimum would have been 12 months.

I spoke about a number of issues when dealing with the Magistrate, and I tendered a number of character references which were based on a template which I had provided the client.

The client also attended a reformatory course which further assisted.

I brought the relevant case law with me and I drafted an Affidavit on behalf of the client explaining his actions, among other things.

I was able to persuade the Magistrate to hand down the mandatory minimum 6 month disqualification. Needless to say the client was extremely happy.
