BEENLEIGH: DUI Drink Driving 0.134 Work Licence Granted

I appeared at Beenleigh Magistrates Court again this morning to act for a client charged with Mid Range DUI Drink Driving, with a blood alcohol concentration of 0.134.

My client was a first time offender.

She had not previously lost her licence within the 5 years prior.

My client was therefore eligible to apply for a Work Licence, and that is what she instructed me to do.

My client was employed as a Payroll Officer.

While her role in itself was not driver’s licence dependent, she lives some distance from her place of employment, and getting to and from work without a driver’s licence would have been near on impossible.

My client faced a maximum penalty of 9 months imprisonment and 28 penalty units.

The maximum 12 month driver’s licence disqualification is doubled to 24 months when a Work Licence is applied for.

A penalty unit in Queensland is currently valued at $113.85.

Further, persons who plead or are found guilty in the Magistrates Court must pay the Offender Levy, which is presently worth $107.10.

I drafted a 10 page Affidavit in support of my client’s DUI Drink Driving Work Licence application.

I covered a number of matters in the Affidavit materials, including the financial liabilities which would not be met if my client lost her income.

I drafted a further Affidavit for my client’s employer to sign, which detailed the consequences of a loss of licence.

I also made detailed and comprehensive verbal submissions to the Magistrate covering a number of key aspects.

I was able to persuade the Magistrate to grant my client’s DUI Drink Driving Work Licence application.

My client received a 7 month driver’s licence disqualification and a $700 fine.

The Work Licence order overlaps the 7 month disqualification period, allowing my client to continue driving for work purposes only.

So for work purposes, my client effectively has not lost her licence.

My client was extremely happy with the outcome.
