BRISBANE CITY: Repeat Unlicensed Driving

I appeared at Brisbane Magistrates Court again today, representing a client charged with Repeat Unlicensed Driving.

My client forgot to renew their licence.

This was my client's fourth unlicensed driving offence, and he was specifically charged as a Repeat Offender.

My client faced a maximum penalty for their Unlicensed Driving offence of a lifetime driver’s licence disqualification, 12 months imprisonment and 40 penalty units.

Magistrates have a general power to impose up to a lifetime driver’s licence disqualification, above and beyond any legislated disqualification ranges.

Given my client was charged as a Repeat Offender, they faced a Mandatory Minimum licence disqualification of no less than 1 month.

A penalty unit in Queensland is currently valued at $121.90.

Further, persons who plead or are found guilty in the Magistrates Court must pay the Offender Levy, which is presently worth $114.80.

I made detailed and comprehensive verbal submissions to the Magistrate covering a number of key aspects.

I was able to persuade the Magistrate not to go beyond the Mandatory Minimum 1 month disqualification.

My client received a 1 month licence disqualification and a modest fine.

My client was extremely happy.

Unlicensed Driving is a serious offence.
